1. Acceptance of Terms

By accessing our website, submitting your phone number, or using any service provided by SouthPeak Systems LLC ("SouthPeak Systems," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

SouthPeak Systems LLC provides an AI-powered missed call recovery service that automatically sends SMS messages to individuals who have called a client's business phone line and did not connect. The SMS service is designed to assist with appointment booking and basic inquiry responses.

We also offer a voluntary SMS opt-in program through which individuals may consent to receive appointment booking assistance messages directly from SouthPeak Systems LLC.

3. SMS Messaging Program

By opting in to our SMS program or receiving messages through our missed call recovery service, you acknowledge and agree to the following:

• Message Frequency: Message frequency varies. You may receive one or more messages per interaction depending on your responses and scheduling needs. There is no fixed message frequency — messages are sent only in response to missed calls or direct opt-in activity.
• Message and Data Rates: Message and data rates may apply. Standard SMS and data rates charged by your mobile carrier may apply to messages sent and received. SouthPeak Systems LLC is not responsible for any charges imposed by your carrier.
• Supported Carriers: Most major US carriers are supported. Carrier support is not guaranteed for all carriers.
• Program Purpose: Messages sent through this program are limited to appointment booking assistance and related communications. We do not send promotional, marketing, or unrelated messages.

4. How to Opt Out

You may opt out of receiving SMS messages from SouthPeak Systems LLC at any time using any of the following methods:

• Reply STOP: Text the word STOP to any message you receive from us. You will receive a single confirmation message and no further messages will be sent to your number.
• Reply CANCEL, UNSUBSCRIBE, END, or QUIT: These keywords are also recognized and will process your opt-out request.
• Email: Send an opt-out request to bgordon@southpeak-systems.com with your phone number and we will remove you within 5 business days.

After opting out, your phone number will be added to our suppression list. You will not receive further messages unless you explicitly opt back in.

6. User Responsibilities

By using our services, you represent and warrant that:

• You will not use our services for any unlawful purpose or in violation of any applicable regulations.
• The information you provide to us is accurate and complete.

7. Intellectual Property

All content on the SouthPeak Systems website, including text, graphics, logos, and software, is the property of SouthPeak Systems LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. SouthPeak Systems LLC does not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee specific results from use of our missed call recovery service.

9. Limitation of Liability

To the fullest extent permitted by applicable law, SouthPeak Systems LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services, even if we have been advised of the possibility of such damages.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Lexington County, South Carolina.

11. Changes to These Terms

We reserve the right to update or modify these Terms of Service at any time. Changes will be posted to this page with an updated effective date. Your continued use of our services after any changes constitutes your acceptance of the revised terms.
